The Bankruptcy Abuse Prevention and Consumer Protection Act of 2005 (BAPCPA) contains provisions that significantly change the obligations and burdens of creditors’ committees and their members. Committees are assuming ever-increasing roles and responsibilities in Chapter 11 proceedings. Oversight and information sharing requirements present new and developing challenges to committee members. Administar helps creditors’ committees fulfill their administrative and information sharing duties under the Bankruptcy Code and improve the outcomes of restructurings. BAPCPA added section 1102(b)(3) to the Bankruptcy Code, which provides that a creditors’ committee must provide access to, and solicit comments from, creditors with like claims.
